Client Media Consent Agreement
By booking any service(s) with i-thriv: Wellness, Anywhere (“Company”), the Client acknowledges that they have read, understood, and agree to be legally bound by the terms of this Media Consent Agreement.
1. Consent Grant
The Client hereby grants the Company and its authorized representatives an irrevocable, non-exclusive, royalty-free, worldwide license and permission to capture, record, use, reproduce, edit, publish, display, distribute, and otherwise exploit photographs, video, audio recordings, testimonials, or other likenesses of the Client and/or service set-up (collectively, “Media”) in connection with any of the Company’s wellness services, including but not limited to massage, spa parties, yoga, sound baths, facials, and vibroacoustic therapy.
2. Scope of Use
a. The Company shall primarily capture photographs of professional set-ups (including massage tables, décor, and spa party layouts) without guests present, unless express consent is granted by the Client.
b. Media may include images taken inside or outside of the service location but shall not include personal images, identifiable belongings, or names of the Client or their guests without express prior written authorization.
c. With express consent, the Company may also capture Client participation or testimonials.
d. The Company is authorized to use the Media, in whole or in part, in any form or medium, including but not limited to print, digital, online, advertising, educational, and promotional materials, on the Company’s official platforms, including www.i-thriv.com, Instagram, Facebook, LinkedIn, and other marketing or social media channels, now known or later developed.
3. No Compensation
The Client acknowledges and agrees that they shall receive no compensation, monetary or otherwise, for the use of the Media, and hereby waives any right to inspect or approve the final product or its specific uses.
4. Limitations and Revocation
a. This Agreement does not authorize disclosure of private health information, massage notes, or any sensitive medical information protected by law.
b. The Client may revoke consent for future use of Media by submitting a written request to info@i-thriv.com. Upon receipt, the Company shall cease all new use of the Media within thirty (30) days. Prior uses shall remain unaffected.
5. Duration of Consent
This Agreement shall remain valid in perpetuity unless revoked in accordance with Section 4(b).
6. Minors
If the Client is under the age of eighteen (18), this Agreement must be executed by a parent or legal guardian for validity.
7. Release of Liability
The Client hereby releases, discharges, and holds harmless the Company, its owners, employees, contractors, successors, and assigns from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to the lawful use of the Media as described herein.
8. Governing Law
This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of California, without regard to its conflict of law principles.
